Actually, if this is based in the US then if he brings up the 4th amendment here he can prevent her from searching the van. However, that does raise the likelihood of her giving him the ticket and probably even doing a sobriety check on him and whatever she can to get him to give her a reason to search the vehicle. Basically, as soon as the words "4th amendment" leave his mouth she is not allowed to even touch the van unless she can come up with some kind of probable cause.
