Thats a tricky question.

'''The Last Horcrux'''
You are Emily, or are you Emily?  You are a fragment of the soul of Lord Voldemort, possessing the body of Emily.  You are his thoughts, his pattern, controlling Emily’s body with magic like the strings of a marionette.  But your thoughts are also strings, and the quintessence that forms your pattern is indistinguishable from that of Emily’s.

Emily awakens. You are an eleven year old pure blood witch named Emily Lestrange, who is going to start her first year at Hogwarts in one weeks time. Your first thought is that you need to find a wand and your allies, but possessing the body of a young girl affects you far more than you anticipated.
One would assume that certain wizarding laws are similar to their Muggle counterparts.

Since this story occurs in Europe, you could look at the respective inheritance laws.

While I'm unsure of the laws in Europe, the U.S. laws are roughly as follows:
* Inmates may inherit money and properties but if it's a life sentence, the properties would become state property unless they are sold off prior to the inmate's death
* Incarcerated individuals can not be a beneficiary to a life insurance policy. If the beneficiary is incarcerated after being charged with a felony, the funds are forfeit until the charge is expunged from their record.
* While I'm not sure of how you'll handle Andromeda, there are 3 sisters that have a potential claim to #12 Grimmauld Place.
** If all 3 are Death Eaters, then either the eldest or "favourite" would be chosen. However, if she's not a death eater, Andromeda still wouldn't be chosen, because she's a race-traitor. (What's worse, being a death eater or fucking a mud-blood, in the eyes of Walburga Black? The answer: race-traitor is worse.)
* In regards to the Lestrange assets and with Emily being under 17, Bellatrix may have Guardianship of Emily and the Lestrange Estate.

In summary, Sirius is serving a life sentence so no inheritance. Pick one of the three ''Black'' sisters. Emily is still underage, so technically Bellatrix owns the Manor and the Lestrange vault. (The statue ''technically'' doesn't have to answer to Emily either. Notice how the statue uses "Mistress" instead of the Latin "''Domina''"?)

Mr Pib

Thats a tricky question.

One would assume that certain wizarding laws are similar to their Muggle counterparts.

Since this story occurs in Europe, you could look at the respective inheritance laws.

While I'm unsure of the laws in Europe, the U.S. laws are roughly as follows:

  • Inmates may inherit money and properties but if it's a life sentence, the properties would become state property unless they are sold off prior to the inmate's death
  • Incarcerated individuals can not be a beneficiary to a life insurance policy. If the beneficiary is incarcerated after being charged with a felony, the funds are forfeit until the charge is expunged from their record.
  • While I'm not sure of how you'll handle Andromeda, there are 3 sisters that have a potential claim to #12 Grimmauld Place.
    • If all 3 are Death Eaters, then either the eldest or "favourite" would be chosen. However, if she's not a death eater, Andromeda still wouldn't be chosen, because she's a race-traitor. (What's worse, being a death eater or fucking a mud-blood, in the eyes of Walburga Black? The answer: race-traitor is worse.)
  • In regards to the Lestrange assets and with Emily being under 17, Bellatrix may have Guardianship of Emily and the Lestrange Estate.

In summary, Sirius is serving a life sentence so no inheritance. Pick one of the three Black sisters. Emily is still underage, so technically Bellatrix owns the Manor and the Lestrange vault. (The statue technically doesn't have to answer to Emily either. Notice how the statue uses "Mistress" instead of the Latin "Domina"?)
